O <br /> O O CITY of ORONO <br /> : - RESOLUTION OFJH3E®I�COUNCIL <br /> NO. <br /> �kESH0 <br /> 13� a3 7 <br /> A RESOLUTION <br /> GRANTING A VARIANCES TO <br /> MUNICIPAL ZONING CODE <br /> SECTION 78-1279(6) AND <br /> A CONDITIONAL USE PERMIT <br /> PURSUANT TO MUNICIPAL ZONING CODE <br /> SECTION 78-966 <br /> FILE NO. 13-3604 <br /> WHEREAS, Neil Goodwin and Barbara Goodwin, a married couple <br /> (hereinafter "the Applicant") are the owners of the property located at 2975 Casco Point Road <br /> within the City of Orono (hereinafter the "City") and legally described as: attached on Exhibit A <br /> (hereinafter the "Property"); and <br /> WHEREAS, the Applicant has made application to the City of Orono for a <br /> variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction of a new <br /> home ahead of the average lakeshore setback; and <br /> WHEREAS, the Applicant has made application to the City of Orono for a <br /> conditional use permit (hereinafter the "CUP") pursuant to Orono Municipal Zoning Code <br /> Section 78-966 to allow grading for construction of new retaining walls and stair system in <br /> conjunction with removal of the existing retaining walls and stairs within the 75-foot setback on <br /> the Property; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, public hearings were held by the <br /> Orono Planning Commission and City Council on June 17, and July 8, 2013 at which times all <br /> persons desiring to be heard concerning this application were given the opportunity to speak <br /> thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 13-3604. <br /> 2. The Property is located in the LR-1 C One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 0.5 acre and a minimum lot width of <br /> 100'. <br /> Page 1 of 5 <br />
