Walter Graff, Attorney at Law <br />Best & Flanagan <br />3500 IDS Center <br />Minneapolis, MJI 55402 <br />RE:Maureen Bellows and <br />Block 1, Byfield <br />Lot 1, Block 1, By field and Lot 2, <br />Dear Mr. Graff: <br />As you will recall, I an general counsel to John Morrison with <br />respect to the above natter. Mr. Morrison recently entered into an <br />agreement with Maureen Bellows respecting the property described <br />above. As part of that agreement, Mr. Morrison was deeded Lot 1, <br />Block 1, Byfield, Hennepin County, Minnesota and Ms. Bellows <br />continues to own Lot 2. Originally under city of Orono Resolution <br />#1985, the city council approved the final plat for a two lot <br />subdivision for these two particular lots. That particular <br />resolution provided that these two lots have a shared driveway <br />access and was a condition to the split of the parcel into two <br />lots. At the time of the agreement between Maureen Bellows and <br />John Morrison, the parties decided that it would be in everyone's <br />best interest to have a separate access at County Read 14 6 for each <br />of these two particular lots. That, of course, necessitated an <br />amendment to Resolution #1985 from the City of Orono. <br />The City of Orono issued Resolution 22877 (copy enclosed) which <br />amended Resolution 11985 and allowed for two separate accesses for <br />Lot 1 and Lot 2, Block 1, Byfield, subject to certain terms and <br />conditions. As you can see from the enclosed Resolution #2877, <br />this required the owner of Lot 2 (Maureen Bellows) to obtain a land <br />alteration permit for the purpose of upgrading the existing access <br />to Lot 2, as well as providing a fillir., and grading plan to be <br />approved by the city engineer. The access improvements were to be <br />completed by December 1, 1990. <br />Maureen Bellows did not apply for or obtain a land alteration <br />permit nor did she provide a filling and grading plan to be <br />1..
