A RESOLOTION APPROVING A <br />METES AMD BOUNDS SUBDIVISION OP <br />A LOT LINE RBARRANGBIENT AND <br />CREATION OP A PRIVATE BASEMENT FOR PROPERTIES <br />LOCATED AT 4085 « 4105 NATERTOHN ROAD <br />PILE NO. 1612 <br />WHEREAS, the City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota; <br />and <br />WHEREAS, the City Council of the City of Orono <br />(hereinafter "City Council") has adopted subdivision regulations <br />for the orderly, economic and safe development of land within the <br />City; and <br />WHEREAS, the City Council has considered the <br />application for a subdivision of a lot line- rearrangement and <br />creation of a private access easement by Joseph Sawchuk, <br />Christopher P. Dale and Geri Lee Paulson (hereinafter "the <br />subdividers") of properties legally described on the survey <br />attached to this resolution (as Tracts A and B), (hereinafter <br />"the property"); and <br />WHEREAS, Council has granted a lot width variance to <br />Tract A based on the following findings; <br />1. The subdivision does not involve the creation of new <br />building sites, but merely the readjustment of the shared <br />lot line between Tracts A and B. <br />2. All existing structures and improvements on Tract A meet <br />the required setback from the newly defined setback line. <br />3. Tract B is severely substandard in area and lot width <br />based on RR-IA standards, and the proposed division will <br />increase the area and lot width of Tract B. <br />WHEREAS, the subdividers have completed all <br />requirements of the City for metes and bounds subdivision of a <br />lot line rearrangement for division and combination purposes. <br />Pa<,e 1 of 3
