Anyone interferring with this policy will face <br />disciplinary proceedings including possible discharge. <br />4. As part of the principal of equal opportunity employment, <br />the work environment shall be free from sexual harassment and <br />intimidation. Such conduct interferes with employee’s work <br />erformance and creates a hostile or offensive work environmen't"!f n carrying out this policy, the City recognizes that sexual <br />harassment is a form of discr imination and as such is subject to <br />applicable state and federal laws. <br />Sexual harassment consists of unwelcome sexual advances, requests <br />for sexual favors, and other inappropriate verbal or physical <br />contact of a sexual nature when made by any member of the City <br />staff: <br />explicitly or implicitly, a <br />^ III t <br />term or condition of an <br />individual ’s employment. <br />(b)When submission to or reiection of such conduct bv an <br />individual is used as the basis for employment decisions <br />affecting that individual, or <br />(c)When such conduct has the purpose or effect of <br />substantially interfering with an individua <br />professional performance or creating an intimidating. <br />The City assures all employees, including (for these purposes <br />only) casual, dav. or independent contractors, have the right to <br />file a complaint concerning harassment, sexual or otherwise. If <br />the "employee** feels that she or he cannot go to their immediate <br />supervisor, he or she may speak to the City Administrator. <br />If a complaint is filed against the City Administrator, the City <br />Council shall appoint an independent investigator to review the <br />complaint and to report directly to the City Council. <br />The City assures that all claims of harassment will be handled in <br />strictest confidence. <br />The City assures that no reta1 iation will fall to anyone <br />>p__________________________________________________________________________________ <br />inscancea when, after investigation, the allegations are either <br />inicomplaining of sexual or other forms of harassment, even in those <br />unaubatantlated or Incorrect. All personnel are cautioned that. <br />certain t^cs of Knowingly false statements which are hurtful to <br />another inav result in defamation charges. Any person found to <br />have defamed another, will be subject to appropriate civil, <br />criminal and internal disciplinary procedures. <br />Sexual harassment mav include, but is not limited to. the <br />following:
