, .�o�o <br /> C ITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��q tiG~ No. 6475 <br /> kEsxo� <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission <br /> held a public hearing on November 17, 2014, at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> WHEREAS, The Planning Commission reviewed this application on <br /> November 17, 2014, the Planning Commission voted on two separate motions. The first <br /> motion was to recommend approval of the side and rear setback variances allowing the <br /> second story additions as proposed. This motion passed with a 5 to 0 vote. A second motion <br /> regarding approval of the requested hardcover and structural coverage variances to permit <br /> construction of a lakeside deck passed with a 4 to 1 vote and was conditioned upon the <br /> following: <br /> a. Removal of the deck/landing and stair on the south side of the home; the door <br /> should be converted to a window. <br /> b. The deck must be constructed as "pervious" and the patio below removed. <br /> c. No expansion, enclosures or changes to the footprint or the nature of the deck <br /> would be permitted in the future without further Planning Commission and city <br /> Council approvals. <br /> WHEREAS, on November 17, 2014, the Planning Commission's <br /> recommendations were based on the following findings. <br /> PLANNING COMMISSION FINDINGS <br /> 1) Resolution No. 4640, adopted in 2001, granted variances to the property regarding the 6 <br /> foot side setback for the garage, the side setback variance allowing the second story and <br /> permitted 2,961 square feet (17.4% as adjusted based on current lot area calculations) of <br /> structural coverage. <br /> 2) The second story additions to the home are proposed to be constructed over the existing <br /> footprint of the home. <br /> 3) The variance to allow construction over the existing home within the 10 foot side setback <br /> wi�l alleviate a practical difficulty inherent to the Property's width and not created by the <br /> Applicants. <br /> 4) The Applicants' initial proposal when revised per the Planning Commission's <br /> recommendation results in 3,261 square feet of structure or 19.2% where 15% is the <br /> maximum permitted and 4,738 square feet or 27.8% of total hardcover where 25% is <br /> permitted by code. <br /> 5) The Applicants have agreed to removal of the existing 60 square foot deck and stair on <br /> the south side of the home in order to offset the structural coverage and hardcover levels <br /> on the Property. <br /> •Page 2 of 7 <br />
