' � o �� . <br /> .�Q�VO I '� 0 <br /> C ITY OF ORONO <br /> RESOLUTION OF THE CIT'Y COUNCIL <br /> y`�lq ti G~� N O. � � � � <br /> kEsxo�` <br /> A RESOLUTION <br /> GRANTING SETBACK VARIANCES <br /> FROM ORONO MUNICIPAL CODE <br /> SECTIONS 78-350 <br /> AND DENYING VARIANCES FROM <br /> ORONO MUNICIPAL CODE SECTiONS 78-1403 and 78-1700 <br /> FILE NO. 14-3697 <br /> WHEREAS, Gary Marquardt and Joan Marquardt, a married couple, <br /> (hereinafter "Applicants") are the owners of the property located at 2617 Casco Point Road <br /> within the Ciry of Orono (hereinafter "City") and legally described as: That part of Block1, <br /> and that part of Lot 16 Block 2 and that part of Orono Avenue, vacated by <br /> abandonment, all in "Winship's Subdivision of Lot 1, Spring Park 2"d Division", <br /> � described as commencing at the northeasterly corner of Lot 141, Spring Park; thence <br /> � northeasterly along the extension of the easterly line of said Lot 141, a distance of 94.5 <br /> � feet to the point of beginning; thence northwesterly deflecting to the left 101 degrees <br /> 13 minutes, to the shore of Lake Minnetonka, said line hereafte� referred to as Line <br /> "A"; thence southerly along said shore, 52 feet, more or less, to the northerly line of <br /> said Lot 141; thence southeasterly along said northerly line to the northeasterly corner <br /> of said Lot 141; thence northeasterly to a point on the extension of said Line "A", <br /> distant 12.8 feet southeasterly from the point of beginning; thence northeasterly along <br /> the last described extension to the point of beginning. Hennepin County, Minnesota, <br /> (hereinafter"the Property"); and <br /> WHEREAS, the Applicants have made application to the City for a variance <br /> from Orono City Code Section 78-350 which requires a 30-foot rear street setback to permit <br /> construction of second story addition 29.9 feet from the rear street property line; and <br /> WHEREAS, the Applicants have made application to the City for a variance <br /> from Orono City Code Section 78-350 which requires a 10-foot side setback to permit <br /> construction of second story addition over the garage as close as 6 feet from the side <br /> property line and over the lake side of the home as close as 8 feet from the side property <br /> where a 10 foot setback is required; and <br /> WHEREAS, the Applicants have made application to the City for a variance <br /> from Orono City Code Section 78-1403 to permit 3,321 square feet (19.5%) structure on the <br /> property where 2,549 square feet or 15% structural coverage is permitted and 3,033 square <br /> feet(17.8%) currently exists in conjunction with construction of a new lakeside deck; and <br /> WHEREAS, the Applicants have made application to the City for a variance <br /> from Orono City Code Section 78-1700 to allow 4,898 square feet or 28.8% hardcover on the <br /> property where 4,248 square feet or 25% is permitted in conjunction with construction of a <br /> new lakeside deck; and <br /> Page 1 of 7 <br />
