�o�o <br /> C ITY OF ORONO <br /> RESOLUTION OF THE CITY COUNCIL <br /> y�l,� �,�'` �o. 6 4 5 8 <br /> kESHO� <br /> 2) Plans to keep the fire lanes open to the pubiic, <br /> 3) May actively promote the use of fire lanes, through signage, <br /> demarcation, or other means, <br /> 4) May further develop fire lanes to enhance or increase the level <br /> of public access to Lake Minnetonka. Examples of <br /> development of the fire lane include, but are not limited to, <br /> installing sidewalks, paving a trail or road, adding benches or <br /> other amenities and etc. within the fire lane, <br /> 5) Is not required to screen the fire lanes from adjacent properties. <br /> The City may institute measures through development <br /> approvals or other means to preserve landscaping and regulate <br /> or remove encroachments which have the potential to interfere <br /> with direct access by the general public. <br /> 4. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, <br /> comments by the Applicants and the public, and the effect of the proposed <br /> variances on the health, safety and welfare of the community as well as the <br /> impact on properties in the vicinity. <br /> 5. The City Council finds that the conditions existing on this Property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variance would not adversely affect traffic conditions, light, air nor <br /> pose a fire hazard or other danger to neighboring property; would not merely <br /> serve as a convenience to the Applicants, but is necessary to alleviate a <br /> practical difficulty; is necessary to preserve a substantial property right of the <br /> Applicants; and would be in keeping with the spirit and intent of the Zoning <br /> Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants a variance from Orono <br /> City Code Section 78-330 which requires a 35-foot side street setback to permit construction <br /> of a new residence 15 feet from the side street property line; subject to the conditions listed <br /> below: <br /> 1. Council approval is based on the survey and building plans submitted by the <br /> Applicants and annotated by City staff, attached to this Resolution as Exhibits A 8� B. <br /> Any amendments to these plans may require further Planning Commission and City <br /> Council review. <br /> Page 3 of 5 <br />
