The City Council finds that granting the CUP and wetlands alteration permit would <br /> not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger <br /> to neighboring property; and would be in keeping with the spirit of the zoning code <br /> and comprehensive plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants approval of a CUP <br /> and wetlands alteration permit pursuant to Orono Municipal Zoning Code Sections 78-967 and <br /> 78-1610 to allow grading and filling activities within a Type 3 wetland on the Properties which <br /> involves excavation of approximately 0.5 acre and thin spreading the excavated material over <br /> approximately 1.60 acres within the wetland on the Properties; subject to the following <br /> conditions: <br /> 1. Council approval is based on the survey and plans (hereinafter the "Plans") submitted by <br /> the Applicant and annotated by City staff, attached to this Resolution as Exhibits A 8� B. <br /> Any amendments to the approved Plans which are not in conformity with City codes will <br /> require further review in accordance with local, State, and Federal requirements. <br /> 2. The Applicant shall implement the landscape plan as proposed. <br /> 3. The drainage patterns created by the grading plan for the site shall not cause an <br /> increase in runoff impacting adjacent properties. The City engineer has reviewed and <br /> approved the grading plan. <br /> 4. Prior to the commencement of grading and filling activities on the Properties the <br /> Applicant shall apply for and obtain a zoning permit for major land alteration. <br /> 5. Prior to the issuance of the zoning permit for major land alteration, evidence of <br /> compliance with all other requirements of local, State, and Federal entities shall be <br /> provided to the City. <br /> 6. Authorities granted by this resolution run with the Properties not with the Applicant, but <br /> are permissive only and must be exercised by applying for and obtaining an zoning <br /> permit for major land alteration and commencing said project within one year of the date <br /> of Council approval, or the CUP and wetlands alteration permit will expire on that date <br /> (October 13, 2015). <br /> 7. Violation of or non-compliance with any of the terms and conditions of this resolution <br /> shall constitute a violation of the zoning code, shall automatically terminate any authority <br /> granted herein, and shall be punishable as a misdemeanor. <br /> Page4of8 <br />
