r[ <br />ie- <br />Deephaven Flexibility Request <br />OctoUi 16,1992 <br />Page Two <br />mJTtnTNG HEIGHT <br />Deephaven currently has maximum residential building height restrictioiw that <br />range from 30 to 40 The Qty utilizes the Uniform Building Code definition for <br />structural height. In reviewing the Shoreland Management Ordinance, the <br />Deephaven Qty Council and Planning Commission were concerned with building <br />height, particularly since the UBC definition allows structures in excess of the <br />maSmum sUted height As a result of that concern, the Qty is proposing to <br />fffab i**** 30 feet as the maximum building height in all residential zones. This will <br />require flexibility from the State standards which stipulate a maximum building <br />height of 25 feet. <br />IMFgR VlOl IS mVFR <br />Deephaven proposes to < ^ply with the State standard of 25% impervious cover in <br />all residential areas. In l corunerdal district, the Shoreland Ordinance will all ow <br />up to 75% impervious cover providing that an adopted stormwater management <br />plan is in place. Without the stormwater management plan, impervious cover will <br />be limited to 25%. <br />SHQREL.tND AREA IMPROVEMENT <br />Deephaven's current Zoning Ordinance contains provisions that in general, far <br />exceed the minimum land use and lot area requirements found in the State <br />fhyiatiH rulss. In addition to those provisions, the Oty is taking a more restrictive <br />position on other shoreland controls sudi as prohibiting waiar-otienle d acce ssory <br />structures and requiring a miiUmum structural setback of 100 feet from Lake <br />Mismetonka's ordinary high water line. <br />■
