A RESOLDTION GRANTING <br />VARIANCES TO MUNICIPAL ZONING CODE <br />SECTION 10.03r SUBDIVISION 15 (F), <br />SECTION 10.61, SUBDIVISION 5 (A) <br />AND SECTION 10.03, SUBDIVISION 21 (3) <br />PILE #1773 <br />WHEREAS, Robert V. Koehnen and Michel E, Koehnen <br />(hereinafter "the applicants") are owners of the property located <br />at 537 Hanlon Avenue within the City of Orono (hereinafter <br />"City") and legally described as follows: <br />Lots 4, 5 and 6, Block 14, Minnetonka Bluffs, Hennepin <br />County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for <br />variances to Municipal Zoning Code Section 10.03, Subdivision 15 <br />(F) and Section 10.61, Subdivision 5 (A) to allow major <br />structural repairs to an accessory structure/garage that iS <br />located 7.45' instead on the required 10' from a side setback lot <br />line and 5.1' instead of the required 10' from the rear lot line <br />and a variance to Section 10.03, Subdivision 21 (3) seeking <br />approval of land alterations consisting of a boulder retaining <br />wall constructed at the north side lot line where no such land <br />alterations are allowed. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #1773. <br />2. The property is located in the RR~1B, Rural Residential <br />Zoning District requiring 2 acres in area. The <br />property consists of 19,396.5 s.f. or .45 acres. <br />3. The Orono Planning Commission reviewed this application <br />on October 19, 1992, and recommended approval of the <br />proposed variances based upon the following findings: <br />A. Steeper elevations to the east side of the <br />structure prevents movement further away from <br />street. <br />Page 1 of 5
