o; o CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO.________________ <br />A RESOLDTION APPROVING A <br />METES AND BOUNDS SUBDIVISION OF <br />A LOT LINE RE7VRRANGEMENT FOR <br />INVOLVING THE PPOPERTIES LOCATED <br />AT 60/70 MYRTLEWOOD RO.A ,> <br />FILE NO. 1759 <br />WHEREAS, che City of Orono is a municipal corporation <br />organized and existing under the laws of the State of Minnesota* and <br />WHEREAS, the City Council of the City of Orono (hereinafter <br />"City Council") has adopted subdivision regulations for the orderly, <br />economic and safe development of land within the City; and <br />WHEREAS, the City Council has considered the application for <br />a subdivision by Patrick Proft and Ray J. Wells, Jr. (hereinafter the <br />subdividers") of a property legally described on the Certificate of <br />Survey by Sathre-Berquist, Inc. dated July 22, 1992 revised September <br />2, 1992 and attached to this resolution as Exhibit "A"; <br />WHEREAS, the subdividers have completed all requirements of <br />the City for metes and bounds subdivision for division and combination <br />purposes by dedicating to the City a Flowage and Conservation Easement <br />over designated wetlands areas within Parcels X, Y and Z as shown on <br />the survey noted above. <br />WHEREAS, the City Council has approved the subdivision of a <br />lot line as proposed whereby the area of one property that does not <br />meet current area standard is reduced further in area based on the <br />following findings: <br />1.The .259 acre parcel consisting of half dry and wetland <br />areas has been confirmed as area unsuitable for septic use <br />because of its proximity to the designated wetland. <br />2.Location of house and turn around on Proft property has <br />created a need to require the additional dry buildable land <br />to the southwest of the house structure. <br />3.The unusual shape of the Proft property and the location of <br />the wetlands. <br />Page 1 of 4 <br />•«
