i <br />AN ORDINANCE AMENDING MUNICIPAL CODE SECTION 9.21, <br />PUBLIC NUISANCE; AND ADDING SECTION 9.23, <br />PARTICIPATION IN NOISY PARTIES OR GATHERINGS <br />The City Council of Orono ordains; <br />Section 1. Section 9.21 of the Municipal Code as revised by <br />Ordinance No. 51, Second Series on May 9, 1988, is hereby amended <br />to read as follows; <br />SECTION 9.21. PUBLIC NUISANCE. It is unlawful for any <br />person to maintain a public nuisance by his act or failure <br />to perform a legal duty, and for purposes of this section, a <br />public nuisance shall be defined as any of the following; <br />(1) Maintaining or permitting a condition which <br />unreasonably annoys, injures, or endangers the safety, <br />health, morals, comfort or repose of any considerable number <br />of members of the public; or, (2) interfering with, <br />obstructing or rendering dangerous for passage, any street, <br />public right-of-way, or waters used by the public; or, (3) <br />any other act or omission declared by law to be a public <br />nuisance. <br />Section 2. The Municipal Code c£ Orono is herely amended by <br />adding Section 9.23, PARTICIPATION IN NOISY PARTIES OR <br />GATHERINGS, to read as follows; <br />SECTION 9.23. PARTICIPATION IN NOISY PARTIES OR GATHERINGS. <br />A. No person shall congregate because of, or <br />participate in, any party or gathering of people from which <br />noire emanates of a sufficient volume or of such nature to <br />distirb the peace, quiet, or repose of other persons. <br />B. A police officer may order all persons present at <br />such party or gathering other than the owners, residents or <br />tenants of the building or place to immediately disperse. <br />Any person who shall refuse Lo leave after being ordered to <br />do so by a police officer shall be guilty of a violation of <br />this ordinance. <br />C. Any owner, tena’^t or resident of the building or <br />place who has knowledge of the disturbance and fails to <br />immediately abate said disturbance shall be guilty of a <br />violation of this ordinance. <br />A-Mii- i—
