Since that time, the applicant has <br />installed the shared drive along the east lot line and the septic <br />staff has confirmed the septic system is approximately 6* from <br />the traveled road. The septic system still remains non- <br />conforming based on the substandard setback from the traveled <br />road (required « existing « 6') and based on Heckman's <br />report of April 14, 1992, existing system has a high potential <br />for future failure. Current septic testing calls for mound <br />systems on all septic sites tested for this property. It is <br />apparent that the required 3* separation could not be met by the <br />trench system existing on the property. Per Section 12.30, Subd. <br />8 (B) (4), the system has been found to be non-conforming and <br />must be replaced within one year of the date of final plat <br />approval. The septic files will be appropriately flagged and the <br />current and future owners notified within the resolution <br />* ,5roving the final plat. <br />Per the County's driveway permit, only one access to the <br />site will be allowed. The new driveway ha been cordoned off. <br />The existing drive will be used during the construction of the <br />new residence on Lot 1. The City has a Developer's Agreement and <br />appropriate form of security to ensure removal of the gravel <br />drive and the restoration of ground cover within Lot 2. <br />Mr. Malik has completed all conditions of preliminary <br />subdivision approval. Staff recommends approval of the final <br />plat, Leslie Addition, subject to the findings and conditions set <br />forth in the enclosed approval resolution. <br />Isv
