MINUTES OF THE LAKE USE COMMITTEE - August 12, 1992 <br />Jabbour stated he personally has more concern with the <br />activites on the site and the effect of the site on the <br />neighborhood than landscaping. Jabbour added that it was his <br />understanding that the reason some of the marinas were nor <br />licensed is because they didn't have any business and couldn't <br />pay the fees. Debbie Breneman said that was ridiculous and the <br />City didn't licc'nse them because they didn't. Jabbour added he <br />was just brainstorming. <br />Schroeder asked to hear from the marina operators, presuming <br />they were aware of certain violations such as landscaping. <br />Debbie Breneman stated they were not aware of these violations <br />and that Gaffron had been out to the marina for a walk-through at <br />one time. She received a letter stating they had added hardcover <br />but that had not been done. The City also gave them a permit for <br />docks. Jabbour referred to a time when there were discussions <br />concerning the fence and vines with Debbie's father. Debbie <br />stated she had permission to keep the fence down as long as trees <br />were planted which had been done. Jabbour said there were <br />landscaping issues which had been going on for several years. <br />Debbie Breneman asked what these issues were and has only <br />received summary statements. She added there is no additional <br />hardcover at the marina. Orono had dug up part of the marina for <br />a sewer project and this is exactly as Orono left it. She has <br />asked the City for 2 years about the bushes to be replaced and <br />grass replanting. Four small bushes had been planted but have <br />all died. <br />Jabbour referred to the Comprehensive Plan that specifically <br />does not allow the sale of boats in marinas. This Council wants <br />to change that. There are certain faults in the code and need to <br />be changed. <br />Mark Breneman stated that Gaffron had been out and went over <br />what reeds to be done for improvements. They are working on <br />this. At the scune time, the City says some things are unsightly <br />so can't be done. For example, trailers parked between the racks <br />and road are legal to have but this is unsightly so should be <br />moved. Calculations on storing winter boats have changed and the <br />method of determining the required space for winter boat storage <br />is not necessarily accurate. He feels it should be back to the <br />basis of how it was done for the last 20 years or redo <br />everything. Callahan and Jabbour agreed that everything needs to <br />be redone. <br />Callahan said the discussion at this time was whether to <br />grant the licenses, not change ordinances. Someone has to decide <br />if the marinas have or have not met the requirements. The City <br />staff is interpreting and enforcing the requirements. If the <br />staff cannot tell whether they are in violation or not, then <br />advice from a lawyer may be necessary. It is not possible for <br />Council to take any action unless: 1) an attorney is asked to <br />determine if a violation exists, 2) they are in violation, or 3) <br />they are not in violation.
