14INDTES OF THE LAKE DSE COMMITTEE - August 12, 1992 <br />June 24, 1992 meeting. He noted that the licensing section is <br />linked to the land use section of the code and felt these two <br />areas should be separate. One of the problems with the marinas <br />is that the nature of the business is intrusive upon the <br />neighorhood and City. He thinks there should be regulation of <br />the operation of the business in a way that satisfies the needs <br />of the City and the residents. The City wants them to conform <br />to certain requirements about the use of the land and zoning but <br />the main concerns would be the encroachment upon the neighboring <br />businesses both on land and on boats, hours of operation and the <br />"commotion" the business causes. <br />The present code limits the activities of the marinas so <br />that it doesn't cover current activities such as boat clubs or <br />charter boat operations. These have more to do with the running <br />of the business than land use. He suggests considering the <br />licensing ordinance section of the code to define marinas, if <br />necessary, and their activities. They should be required to be <br />licensed, apply once a year, have the license authorize activites <br />they would be allowed to do, deal with dry stacking as a <br />building, require them to stay within an envelope that extends <br />into the water and maintain a sufficient number of parking spaces <br />within their property. <br />Kelley asked if this meant there would be a separate code <br />section just for marinas. Callahan replied there was currently a <br />separate section. Kelley agreed and then asked if there would be <br />language saying there would be no "jumping" between code sections <br />but staying within one section. He felt this caused some of the <br />confusion. Gaffron did not feel this was a problem and gave an <br />example of parking. There are other sections of code that define <br />the size of a parking space that affects all parking in the City. <br />The number of parking spaces required is defined in the marina <br />section based on the number of slips and the square footage of <br />retail space. This is in both the marina and licensing sections. <br />Callahan stated certain things in the zoning code such as <br />setbacks and building envelope should be part of the license. <br />General land use violations should be left for enforcement under <br />the land use section. Parking spaces could be applied to the <br />license. The license should come up for revocation if violations <br />of the license exist. If a license is revoked, it should not be <br />reinstated automatically the following year. In Callahan's <br />opinion, the enforcement of this section should not be with the <br />Building and Zoning Department but rather the Police Department. <br />In the case of operations (boat clubs or charter boats), the <br />owner of the marina should be the operator and not be sub-leased. <br />Jabbour brought up the issue of parking and charter boats as <br />they would require more spaces. This does not mean the marina <br />should not be allowed to do it, only that these activities should <br />be contained and not "spill over" into the neighborhood. <br />Callahan agreed that boat clubs and charter boats will require <br />more parking spaces.
