BWfcd0\' <br />HINUTES OF THE REGULAR ORCNO COUNCIL MEETING <br />HELD JULY 27, 1992 <br />(♦6) PROPOSED ZONING ORDINANCE - BAN ON STYROFOAM DOCK FLOTATION <br />ORDINANCE #104, SECOND SERIES <br />w Qaffron explained that the ordinance is the result of work by the <br />Lake Use Committee. The Planning Commission has held a public <br />hearing on the proposed ordinance, at whicn time they suggested <br />changes. He noted two draft ordinances have been submitted for <br />review and noted the differences. <br />Butler stated she was willing to adopt whatever is reasonable, but <br />did not wish to drag out the process longer than necessary. She <br />requested that styrofoam buoys also be banned and requested it be <br />added to the language of the ordinance. <br />Callahan submitted a revised draft ordinance which includes a <br />preamble, provides fc.' the ordinance to be included under the <br />public nuIsance section of the code, and defines non-encasad <br />Styrofoam In a similar way. He noted his ordinance requires all <br />non-conforming structures to be removed by December 31, 1994. He <br />added that most marinas using these structures have been doing so <br />for some time, and he felt five years was too long to allow this <br />practice to continue. <br />8^I,-:#."'" ./A- <br />Jabbour noted that this is the third season of use for al i the <br />marinas using styrofoam structures. <br />Hurr stated that the Li'CD approved float'ng docks, but not a <br />Specific type. She noted that l. e LMCD is anticipating adoption of <br />an ordinance banning the use of styrofoam. She suggested that the <br />ordinance be rowordeJ, changing 'City waters’ to "City limits . <br />Jabbour asked how the proposed ordinance addresses replacement of <br />existing docks. <br />Callahan suggected ad-.ng, "this exception does not Include the <br />right to repair or replace . <br />3 <br />fc.
