rIf.;'E.-; /. <br />y^- <br />i^n-r <br />ti'v> <br />t,: <br />i'Sl''6-1.-n <br />V <br />H <br />r <br />1 <br />P"h\ <br />t.;tir». <br />!;'■ <br />I. <br />Hwf <br />I <br />^^:r; », <br />ii..ft <br />1^" <br />fe?‘: <br />yp. <br />Mf <br />A RBSOLOTIOH DETERMINING THAT SANITARY SEWER SERVICE <br />WILL BE PROVIDED TO PROPERTY LOCATED AT *245" TONKA AVENUE <br />KNOWN AS LOTS 5 AMD 6, BLOCK 3 <br />BAYSIDE ADDITION TO LAKE MINNETONKA <br />WHEREAS, the City of Orono is a municipal corporation <br />orgaiiized and existing under the laws of the State of Minnesota; <br />and <br />WHEREAS# the Stubbs Bay Sewer Project was initiated by <br />the City to solve existing on-site sewage treatment problems in <br />the Stubbs Bay area, within which Lots 5 and 6, Block 3, Bayside <br />Addition to Lake Minnetonka, are located; and <br />WHEREAS, the al orementioned Lots 5 and 6 are separate <br />adjacent tax parcels owned in common by a single owner, being <br />described for tax record purposes as PINS number 05-117-23 13 <br />0026 and 05-117-23 13 0027, respectively; and <br />WHEREAS, two adjacent abutting parcels directly north <br />of Lots 5 and 6, namely Lots 3 and 4, Block 3, Bayside Addition <br />to Lake Minnetonka, are currently vacant and the property o%mer <br />of Lots 3 and 4 has indicated to Hennepin County that said lots <br />will be allowed to go tax forfeit; and <br />WHEREAS, the total dry land area of Lots 5 and 6 is <br />approximately 0.29 acres, as compared to the existing zoning <br />regulations requiring 2.0 acres per buildable site; and <br />WHEREAS, said parcel is not buildable without one or <br />more variances from the existing zoning code; and <br />WHEREAS, the potential future availability of adjacent <br />vacant land could increase the total dry land area of the parcel <br />to approximately 0.58 acres; and <br />WHEREAS, construction of a single family residence on <br />Lots 5 and 6, if done according to all zoning performance <br />standards, would not be contrary to the intent of the Community <br />Management Plan; and <br />Page 1 of 2 <br />m , ,
