Planning & Zoning Administrator <br />July 29, 1992 <br />SUBJECT: Lake Minnetonka Shoreland Ordinances - Update <br />List of Exhibits <br />A “ DNR Formal "Flexibility Request" Notification Letters; <br />Orono and Minnetrista <br />B - City of Woodland Preliminary Flexibility Request <br />C - City of Spring Park Preliminary Flexibility Request <br />Status of Orono*s Ordinance <br />Attached is a copy of the letter from Pick to the other Lake <br />Minnetonka cities which formally triggers the forty-five day response <br />period. Midway through the process, DNR determined that once cities <br />have submitted their flexibility request to the DNR, the DNR would <br />review it and then the DNR would be responsible for sending the <br />flexibility request to neighborxng cities for comment. This policy <br />was not formulated at the time we sent our flexibility request to the <br />other cities, hence to some extent they are duplicating our efforts. <br />While this is not a problem, it does seem to extend the timeframe <br />before they will formally approve our ordinance. <br />I have yet to receive the previously indicated letter from TNR <br />discussing minor "housekeeping" concerns they have with our ordinance. <br />I presume this will get to us at the end of the forty-five day period <br />which is approximately September 2nd. <br />At the point which they are prepared to formally approve our <br />ordinance, we ill have to do the minor revision to revise the slope <br />criteria from 18% to 12%. <br />Status of Other City's Shoreland Ordinances <br />Minnetrista's informal flexibility request was reviewed by <br />Council in July. Attached is a copy of the formal notification for <br />review. Since we have already reviewed this, I will do nothing more <br />than cc a copy of ray letter to Jay Blake (copy attached) to the DNR. <br />Wood].and presented their flexibility request to the technical <br />review committee on July 28th. A copy of their informal flexibility <br />request is attached, and appears to be relatively minor in scope and <br />impact. <br />■f ' .jr... ..
