265 Hollander Road <br /> Orono, MN 55391 <br /> April 8, 2024 <br /> City Council <br /> City of Orono <br /> 2750 Kelley Parkway <br /> Orono, MN 55356 <br /> Re: Observations and Comments Concerning LA24-000009 <br /> Dear Orono City Council: <br /> Thank you for the opportunity to provide these thoughts regarding the <br /> proposed development on 797 Ferndale Road North (797). <br /> Considering that 797 is presumed to be buildable, my main concern is that all <br /> due care is used in granting both this average lakeshore setback variance as <br /> well as any other variances that may become necessary to grant over the <br /> course of the project. I have read the other letters that will be presented <br /> tonight and am in substantial agreement with them. My interest is primarily <br /> that this proposed project wilt adhere to all normal building requirements. <br /> What follows is a list of my observations— in no particular order: <br /> 1. The survey and plans for 797 show the boundaries defined by the <br /> current lake level (970.9') as well as the location of wetland <br /> delineation stakes that appear to have been temporarily placed at <br /> the 30-year high water mark (973.03'). The 150'setback that is <br /> illustrated in the survey/plan is measured from the current Lakeshore <br /> — not the provisional wetland boundary. The difference is about 6", <br /> resulting in a setback from the provisional wetland boundary of 144'. <br /> The MCWD has not yet reviewed the delineation study done by <br /> Kjolhaug and will not likely do so until the growing season. The <br /> actual proposed setback cannot be known until MCWD completes <br /> its review. This might argue for postponing this matter until such <br /> time. <br /> 2. I have attached three exhibits that illustrate the 100-year high water <br /> mark, which both Orono and MCWD consider in their approval work. <br /> 1 <br />
