’T., ■■ ■f <br />k>- <br />:'5, <br />I- <br />F <br />ff. <br />eS <br />4.V- , <br />X AAC City Council finds that granting a conditional use <br />permit to allow the installation of a pond as proposed will <br />not be detrimental to the health, safety or general welfare <br />of the public, would not adversely affect light, air nor <br />pose a fire hazard or other danger to neighboring <br />properties, nor will its use depreciate surrounding property <br />values and that the proposed level of use of the property <br />will be in keeping with the intent and objectives of the <br />Zoning Code and Comprehensive Plan of the City. <br />5.The City Council has considered this application including <br />the findings and recommendations of the Planning Commission, <br />reports by staff and comments of the applicant and the <br />affect of the proposed use on the health, safety, and <br />welfare of the community. <br />COHCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of' the above findings, the Orono City <br />Council hereby grants a Conditional Use Permit per Municipal Zoning <br />Code Section 10.03, Subdivision 19 to permit the installation of a <br />100' diameter pond at a 4' depth as shown on the survey by Coffin and <br />Gronberg, Inc. dated March 17, 1989, subject to the following <br />conditions: <br />1.Banks of the pond are to be installed at a 3:1 slope to <br />facilitate the regrowth of vegetation. <br />2.Vegetation to be restored upon completion of the final land <br />alteration. <br />3.Applicant to provide a drainage easement over the retention <br />pond and upon the final recommendation of the City Engineer, <br />hereby agrees to grant the City additional drainage <br />easements over existing underground tiles that drain to the <br />southern boundaries of the property. <br />4. <br />wW' <br />ppllcant to apply for a land alteration permit from the <br />ity prior to any land alterations.
