CONCISIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the <br />Orono City Council hereby grants a renewal variance to Municipal <br />Zoning Code Section 10.23, Subdivision 6 (B) to permit the <br />construction of a single family residence on this lot that does <br />not meet the required width at the front street setback line <br />measuring 30* instead of the required 200', subject to the <br />following conditions: <br />1. Any proposed residence must meet the required minimum <br />setbacks established for the LR-IA zoning district and <br />must further meet the required setbacks from drainfleld <br />sites. <br />2. A diagram of the building envelope and approved <br />drainfield sites are enclosed as Page 6 of this <br />resolution, to adivse future potential buyers of the <br />property of the building site limitations. <br />3. Any proposed residence or d /elopment of the property <br />shall meet the hardcover requirements of the LR-IA <br />zoning district. <br />4. No other zoning variances for development of this <br />property will be granted. <br />5. The approved access for the property is a single <br />driveway at County Road 15. <br />6. A building permit for the construction of a residential <br />dock on the lakeshore portions of this property shall <br />not be issued until a Certificate of Occupancy is <br />issued for new residence. Based on the limited land <br />area on the lakeshore portion of the property, the City <br />will permit no other permanent structures except for a <br />residential dock and the temporary storage of dock <br />factions during the winter months shall be discouraged. <br />Applicant is further advised to consult with the <br />Minnetonka Conservation District to determine if <br />variance setbacks are necessary for the location of the <br />proposed dock and if there shall be a minimum of slips <br />allowed for dock. <br />Page 3 of 4
