Zoning File #1736 <br />June 2, 1992 <br />Page 2 <br />Additional CoHnents and Planning Commission Recommendation <br />Planning Commission members were concerned that the new <br />owner and applicant be aware of the standards for development of <br />lakeshore properties noting that the previous approvals were <br />based on all standards of the LR-lA zoning district being <br />satisfied. Applicant advised that he did not have formal <br />building plans at this time and was not sure of the applicable <br />lakeshore standards. Applicant was encouraged to work with the <br />Orono staff at the time plans were being developed for future <br />residential construction. <br />Please review Exhibit D. Note survey shows property's <br />boundaries extend to the shoreline. Property measures <br />approximately 20' in width. There is no record of any previous <br />discussion concerning riparian access. Applicant should be <br />advised to contact the LMCD if a dock is to be constructed on the <br />lakeshore portion of the property to determine if residential <br />dock is to be limited to the specific number of slips and if <br />variance review would be required. The enclosed approval <br />resolution has been amended to now cover notice to the applicant <br />of the need to consult with the LMCD prior to the installation of <br />residential dock. Note the condition also states that a <br />Certificate of Occupancy must have been issued for residence on <br />property before City would issue a building permit for the <br />construction of the seasonal dock. Because of the limited land <br />area of the lakeshore portion of the property, no permanent <br />structures except for a dock will be allowed. <br />The current approval resolution has been amended to also <br />exclude the requirement of a park dedication fee payment. In <br />fact the resolution of 1990 should have been amended to exclude <br />such property. It was the City Attorney's opinion that the new <br />park dedication fee ordinance did not require existing lots of <br />record to make payment of park dedication fee at the time of an <br />application for building permit. <br />The enclosed approval resolution has been drafted per the <br />Planning Commission recommendation with the additional conditions <br />as act forth by staff above. <br />Isv
