A RESOLOTION GRAHTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 15 (C) <br />PILE #1731 <br />NBERBAS, Clair T. Rood, hereinafter "the applicant") is the <br />owner of the property located at 3240 and 3280 Navarre Lane within <br />the City of Orono (hereinafter "City") and legally described as <br />follows: <br />Refer to Exhibit "A" attached. <br />WHEREAS, the applicant has applied to the City for a <br />variance to Municipal Zoning Code Section 10.03, Subdivision 15 (C) to <br />permit the construction of fencing consisting of hedges and 4 1/2' <br />high pillars where only a 3 1/2' high pillar would be allowed adjacent <br />to a public right-of-way. <br />Minnesota; <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #1731. <br />The property is located in the LR-IC Zoning District <br />requiring 1/2 acre in area. Each lot meets or exceeds a 1/2 <br />acre dry contiguous area. <br />3.The Orono Planning Commission reviewed this application on <br />May 18, 1992 and recommended approval of the proposed <br />variances based upon the following findings: <br />The unimproved right-of-way referred to as Hillside <br />Place shown at a 25' width does not meet width <br />requirements for a public or private road and that <br />based on current zoning the roadway will only serve a <br />maximum of two residential units. <br />The proposed location of the 4 1/2' high pillars within <br />the street yards of the properties will not create a <br />sighting problem for the users of the unimproved right- <br />of-way of Hillside Place. <br />Page 1 of 4
