(_ <br /> ��kESH�4'� * <br /> FINDINGS <br /> 1. This application was reviewed as Zoning File number 14-3661. <br /> 2. The Property is located in the LR-1 B One Family Lakeshore Residential Zoning <br /> District which requires a minimum lot area of 1.0 acre and a minimum lot width of <br /> 140'. <br /> 3. The Planning Commission reviewed this application at a public hearing held on <br /> April 21, 2014 and voted 5 for and 1 against on a motion to approve the <br /> variances and conditional use permit. The Planning Commission finds that the <br /> following factors support the granting of the request: <br /> a. The Property contains 74,302 square feet (1.70 acres) in area and has a <br /> defined width of 295' at the OHWL and 156' at the 75-foot setback. <br /> b. A permit has been issued to construct a new residence on the Property in <br /> March of 2014. <br /> c. The project will not adversely impact views of the lake currently enjoyed by <br /> the adjacent properties. <br /> d. With approximately 21% overall hardcover, the Property will conform to the <br /> hardcover limitations of a Tier 1 lot. <br /> e. The proposed walls and stair within the 75-foot setback will not alter the <br /> essential character of the neighborhood and will result in minimal or no <br /> negative impact on adjacent properties. <br /> f. The installation of the retaining walls will help to support the slope and, <br /> combined with the geo-block installation and vegetation instatled on the path, <br /> should help to improve storm water quality and prevent further erosion from <br /> the site. <br /> g. The applicant has provided a landscape plan which will serve to stabilize the <br /> slope as well as screen views of the proposed walls from the lake. <br /> h. The Applicants' request is in harmony with the purpose and intent of the <br /> ordinance. <br /> Page 2 of 4 <br />
