Wine Trust, (hereinafter the "Owner") is the owner of the <br /> property located at 2605 Kelly Avenue within the City of Orono (hereinafter the "City") and <br /> legally described as: <br /> Lot 5, Block 5, Townsite of Langdon Park, County of Hennepin (hereinafter the <br /> "Property"); and <br /> WHEREAS, Scott Wine and Jill Wine, trustees of the Jill S. Wine Trust, <br /> (hereinafter the "Applicants") on behalf of the Owner have made application to the City of Orono <br /> for variances to Orono Municipal Zoning Code Sections 78-1288 and 78-1680 to allow <br /> hardcover in conjunction with construction of a replacement lake access stair and retaining walls <br /> within 75 feet of the OWHL of Lake Minnetonka where no hardcover is permitted; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> variance from Orono Municipal Zoning Code Section 78-1279 to allow construction of a <br /> replacement lake access stair and retaining walls within 75 feet of the OWHL of Lake <br /> Minnetonka to replace an existing deteriorating stair and stabilize the slope; and <br /> WHEREAS, the Applicants have made application to the City of Orono for a <br /> conditional use permit pursuant to Orono Municipal Zoning Code Sections 78-966 and 78-1286 <br /> to allow grading for construction of new retaining walls, stair system and landscape plantings in <br /> conjunction with removal of buckthorn and the existing stairs within 75 feet of the OHWL on the <br /> Property; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the <br /> Orono Planning Commission on April 21, 2014 at which times all persons desiring to be heard <br /> concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> Page 1 of 4 <br />
