Dickey’s <br />Lake Creek, a protected tributary, crosses through the property creating a 150-foot-wide hardcover <br />restricted zone in the front yard. The only access to the buildable area of the property is over the <br />creek and directly through the hardcover restricted zone. The City Code allows for a driveway with a <br />maximum width of 8 feet within the 75-foot setback from protected waters if there is no other <br />access to the property. The new home on the property is currently under construction. The project <br />is nearing completion. The property owner is requesting a variance to allow the 8 foot wide <br />driveway to be increased to 12 feet in width creating new encroachments and additional hardcover <br />on both sides of the creek. <br /> <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified the location of the tributary and safety <br />concerns as practical difficulties supporting the requested variance. Additionally, they have provided <br />supporting documentation regarding Practical Difficulties attached as Exhibit B, and should be asked <br />for additional testimony regarding the application. <br /> <br />Planning Staff Practical Difficulty Analysis: Regarding practical difficulty, Staff finds that the newly <br />created property and roadway corridor were arranged and oriented with the tributary as an existing <br />condition. The City Code provides for a minimal width driveway to provide access in sensitive areas <br />within 75 feet of lakes or protected tributaries. Staff does not find practical difficulties that support <br />the applicant’s request to increase the hardcover within the creek setback. <br /> <br /> <br />Application Summary: The applicant is requesting approval to install a wider driveway than is <br />permitted within 75 feet of the creek. <br />Staff Recommendation: Planning Department Staff recommends denial. <br />6
