It was also his <br />intention to use the existing drive as access to the building <br />■ite. Nhen ai^licant advised that he planned to sell Lot 2 with <br />the eidlsting residence as is. Planning Commission members stated <br />that the house could not remain on the property without a <br />coaforaing septic system and well because structure could remain <br />in this condition for an indefinite period of time and a <br />potential candidate for hazardous building action. Applicant <br />appeared to have accepted the Planning Commission's directive. <br />la a recent «>nversation with Mr. Malik, he advised that the <br />site evaluator confinsed the alternate site in street yard could <br />be extended so that 75* separation is maintained. Malik also <br />advised that he would like the option of selling Lot 2 with <br />residence. Staff advised that a conforming ..eptic system %rould <br />have to be installed by a specified deadline. Staff recossMnds <br />new septic installation either at time of abandonment of existing <br />septic system or within 60 days of the issuance of a Certificate <br />of Occupancy for new residence. Council must specify deadline <br />for septic installation in order to complete resolution (review <br />Condition #1 of resolution). It should be noted that if the <br />ai^licant provides the existing reuidence with a conforming on <br />site septic system and on-site well, the City would have no legal <br />authority to require the removal of the existing residence. <br />Planning Coand.ssiofi Eeconmendation <br />To approve the Class II subdivision application of Greg <br />Malik for the property located at 3060 Sixth Avenue North finding <br />that all standards of the RR-IB zoning district and on-site <br />septic code have been satisfied. The Planning Comnission adopted <br />the staff conditions of approval 1 through 6 omitting #5 for at <br />the time there was no need to grant variance setbacks for the <br />existing structure on Lot 2 as structure was to be removed. The <br />prelimiMry approval conditions will include the request of the <br />City to have the shared driveway installed in the most western <br />portion of Outlot A. <br />The enclosed resolution has been drafted per the Planning <br />I's reconoiendation of approval except for the issue of <br />the existing residence. Staff has added the condition that <br />applicant must install a conforming septic system that meets <br />required separation setback of 75' from existing well. Council <br />must determine deadline for installation of septic system. <br />t-'^ <br />4
