Planning & <br />f Date:April 30, 1992 <br />{■r <br />iV'--'- <br />Subject:3425 Eastlake Street - Sewer Unit? <br />: <br />-List of Exhibits <br />1^.S'r Exhibit A - Sketch <br />Exhibit B - Section 10.55, Subd. 76 <br />i <br />i- <br />*1. <br />(*• <br />Although the property owner of 3425 Eastlake Street has been notified <br />of a one unit sewer assessment at $8,840.00, it has come to staff's <br />attention that the existing structure on that property has neither <br />sanitation facilities nor a foundation, and is merely a 12'x22' (264 <br />s.f.) summer cabin. <br />In the Stubbs Bay area, sewer units were assigned to all developed <br />properties in single separate ownership, without regard to the lot <br />site or nature of existing structures. However, it could be argued <br />that this small cabin is nothing more than an accessory building <br />without a principal structure, and because of its lack of sanitation <br />facilities, has never been an established dwelling unit. <br />The question then becomes, does the City wish to assign a sewer unit, <br />which eventually forces the issue of naving to approve variances to <br />allow something substantial to be constructed on the property. <br />The lot is 50'xl02', or 0.12 acre in a 2 acre zone. .Mso: <br />1.The lot is entirely within a sheet flow flood plain area <br />requiring special considerations for construction. <br />2.It would be virtually impossible to construct a building on <br />the property without variances to front, rear, left and <br />right side, and lakeshore setback variances. (The 929.4 <br />elevation contour extends up the creek from Stubbs Bay to <br />abut this property.) <br />3.It can be argued that the non-conforming use section of the <br />Flood Plain and Wetlands ordinance applies. Section 10.55, <br />Subd. 26 (B) states "B. No structural alteration or <br />addition to any non-conforming structure over the life of <br />the structure shall exceed 50% of its value at the time of <br />its becoming a non-conforming use, unless the structure is <br />permanently changed to a conforming use or unless the <br />alteration or addition would substantially reduce potential <br />flood damages for the entire structure." That ordinance was <br />adopted 1-11-79. The assessor's valuation at that time <br />indicated a structure value of $72*?. 00.
