Mayor Corcoran and Coundlmen: <br />Enclosed is a resolution which embodies the recommendation of the Ash <br />Utilization Demonstration Project Task Force, which was appointed by the City <br />Council, following its extensive study of the draft permit and all information <br />available to it at this time. We appreciate the opportunity to advise the Council on <br />this matter, and after thorough discussion and study, we make the following <br />recommendations to the City Council; <br />The application for a p'crmit should be denied at this time, because accurate <br />standards have not been determined for the protection of the health and safety of <br />people and agricultural products, including standards for ash utilization, surface <br />water standards, standards for petroleum testing of TAP-laden asphalt, and <br />transportotion standards fcr ash and TAP. In addition, the application for a permit <br />does not contain adequate Plans for storage of TAP other than the test storage site, <br />for worker safety, for recycling, and for ultimate removal of the TAP-laden asphalt. <br />Further, no bond has been proposed or required to cover removal of the TAP, <br />should it be proven hazardous, or for any consequential damages to landowners and <br />others. <br />The Task Force further recommends that all possible efforts be made to <br />induce the Minnesota State Legislature to Increase fimding for the Minnesota PCA, <br />particidvly in- the area. of^imds^ibr-eidQnssentJWe have~serious^ concerns abcnrt-^ <br />the ability of the PCA to enforce a permit such as this one, should it be issued, <br />particularly if no bond is required of potential applicants. ______ <br />The Task Force further strongly recommends a moratorium on any further <br />applications for a permit for an ash treatment facility until (1) a permit application is <br />made and a permit is drafted and issued which provides for the above concerns; and <br />(2) adequate testing has been completed and all required test results have been <br />released, including a road test of at least seven years in duration. <br />The Task Force further recommends to the City Council of Dayton that it <br />immediately examine its policies for acceptance of rezoning applications and other <br />applications for permits for industrial facilities in the City of Dayton to determine <br />what standards should be met in deiling with hazardous materials and what bond <br />requirements and application fee requirements should be set for all such applicants. <br />It should actively seek the assistance of the League of Minnesota Cities, the
