Preliminary plat approval will expire April 8, 1992 <br />(review Exhibit D), <br />Request: for Extension <br />Mr. Carlson claims the threat of the southern bypass has had <br />a major impact on his subdivision. Unfortunately, there is no <br />assurance that this matter will be resolved within a year. In <br />the past the City has granted subdividers extensions because of <br />title problems. There is no doubt that Mr. Carlson has made a <br />major financial commitment during this prolonged preliminary <br />subdivision review. (Applicant was required to file a second <br />preliminary plat requiring new engineering plans for roadways, <br />grading and drainage plans with new lot layouts.) <br />The subdivider must not only content with the del /s until <br />the Highway 12 issue is resolved but there is also the issue of <br />new shoreland regulations and the City's new park dedication fee <br />ordinance. Staff can confirm that the Shoreland Ordinance will <br />not negate the approved septic and house locations of the 12-lot <br />plat. Mr. Carlson seeks reassurance that t^e original park <br />dedication fees paid in the original applica- on at $3,200 are <br />still valid through the extension period. The City Attorney has <br />already been consulted on this issue and Barrett has confirmed <br />that Carlson has the right to seek the extension under the <br />ordinance. The subdivider now asks that all ordinances in effect <br />under the original preliminary subdivision approval and as set <br />forth in Resolution #2948 be reapproved. <br />Options of Action <br />Denial. Require applicant to file a new renewal preliminary <br />subdivision applicat i.on and complete conditional use permit <br />review under tabled A^olication #1630. <br />OR <br />Approval of extension request and direct staff to draft an <br />appropriate resolution for action at your March 23rd meeting <br />approving an extenrion through March of 1993.
