Shortly after that approval, the Corps of <br />Engineers in conjunction with the EPA and the U.S. Wildlife <br />Division, denied the subdivision because the major plat road <br />intersected the designated wetland area (Type 6 and 7). It was <br />the opinion of the Corps that the roadway could have been <br />extended along the east and north half of the property where <br />there was no designated wetland. In February of 1991 the <br />applicant filed a revised plan consisting of 12 lots. Review <br />Exhibit B. In conjunction with the revised plat, the applicant <br />filed a conditional use permit and variance application proposing <br />hiking and biking trails, tennis court and gazebo within Outlet <br />C. This time the applicant worked closely with the Corps to <br />determine if applicant was to be issued an individual or national <br />permit. <br />Application #1630 was tabled in March of 1991 pending the <br />Corps of Engineers resolve cf the permitting issue. Applicant <br />has recently notified the City that the Corps has agreed to only <br />a national permit limiting fill to a 10,000 square foot area. A <br />6' wide trail of 1,600 lineal feet is proposed under the national <br />permit. <br />S':: <br />mft ttk '*« M .
