Flaming Commission voted 4 to 0 <br />recosamend adoption of the amendment as rooosed. <br />At <br />to <br />Exhibit C is a draft letter to the Department of Natural <br />Resources regarding adoption of the ordinance and the reasons for <br />our proceeding without their input. Exhibit D is a similar <br />letter to neighboring cities. <br />The l4ike Use Committee has recommended immediate adoption of <br />the ordinance and lifting of tht, moratorium based on the <br />potential for an extended DNR review, which would create a <br />hardship for Orono residents hoping to develop thei” properties <br />In 1992. The Planning Conunisrton concurred with this concern. <br />Because the moratorium was established by ordinance, and v'as <br />written to be effective until August 26, 1992, an ordinance will <br />be required to repeal the moratorium. This requires notification <br />and a public hearing, which will be scheduled before the March <br />Planning Commission meeting, with final action to repeal the <br />moratorium by the Council on March 23. In the meartime, staff <br />would recommend that applicants be allowed to proceeo with <br />applications, except that no preliminary plat approval could be <br />granted ‘y the Council until the moratorium is repealed. <br />Staff Recowendat ion <br />Itaff recommends adop^ ion of :he Shoreland Ordinance, Statf <br />i^^'^ommends that Council direct chat a public hearing be held at <br />the March 16 Planning Commission meeting ▼■egarding repeal o* the <br />moratorium.
