Subseauent1y. upon <br />advice of LMCD Attorney LeFevere, staff recommended an alterna­ <br />tive to license revocation, the following option: to advise <br />North Shore Drive Marina that the Board will consider any license <br />application for 1992 incomplete unless it is accompanied by the <br />required designation of transient and service' slips. Should <br />North Shore Drive Marina proceed to do business in 1992 without a <br />license, a citation will be issued. <br />The executive director said the original staff recommenda­ <br />tion for license revocation could result in the loss of the <br />Marina's grandfathered status. <br />Breneman said it is not reasonable to designate slips for <br />service purposes because of the varying sizes of boats they <br />service. <br />Foster said it is important to have the service and tran­ <br />sient slips designated at fixed locations so inspections can be <br />made to assure compliance. Any otlier method would raise the <br />possibility of renting more slips than the marina is licensed <br />for. <br />There was a discussion about whether North Shore Drive <br />Marina has in the past, stored more watercraft in the lagoon than <br />the eight they are licensed for. <br />Penn asked if the Code requires slip designation. The <br />executive director responded that it does and all other marinas <br />on the lake are in compliance in this regard. <br />Hurr indicated her willingness to look at the Marina’s <br />documents with Grathwol and staff. Foster said in view of the <br />disagreement on what has been dotie. that Breneman bring all of <br />her related documents to the LMCD. <br />It was agreed Grathwol, Hurr, Foster, staff and Breneman <br />will meet after the boat show in late January. Breneman is to <br />bring all of her court documents regarding boat storage. Brene­ <br />man asked that she be shown the slip designations from the other <br />marinas as mentioned earlier by the executive director. <br />3. Parris* Appeal to Nagel Variance Order. <br />The committee received a copy of a Notice of Appeal regard­ <br />ing a variance granted to Terrance and Jill Nagel. No action was <br />necessary. <br />4. Expiration uf Ordinance No. 106 <br />Ordinance 106, An Interim Ordinance Restricting the Licens­ <br />ing, Construction and Maintenance of New Commercial and Multiple <br />Docks expires on 1/31/92. This ordinance is commonly referred to <br />as the "moratorium". <br />Cochran asked if the deadline should be extended. <br />Grathwol has reviewed the committee activities for the past <br />two years. Not all of the problems have been solved. Studies <br />have begun and information accumulated on the three/four boat <br />unlicensed docks, and 100’/200* licensed dock lengths. There is <br />an ongoing study of wetlands. <br />It is Grathwol*s understanding that the Hennepin Conserva­ <br />tion District will supply LMCD with computerized shoreline maps <br />of Lake Minnetonka wetlands to help in the wetlands study-
