LMCD Board of Directors December 4, 1B91 <br />C. Nagel Dock Use Area Variance Draft Order <br />Babcock moved, Pillsbury seconded, approval of the Order as <br />amended by the Water Structures Committee; that the application <br />of Terrance and Jill Nagel, 21895 Byron Circle, 'Greenwood, for <br />variances for adjustment of dock use areas and from setback <br />limitations applicable to canopies, be granted in part and denied <br />in part as set forth in the Order. Motion carried. Rascop voting <br />nay. <br />D. Resolution Setting Application Fees <br />The Board received a Resolution Setting Application Fees for <br />Licenses for Multiple Docks or Mooring Areas, Commercial Docks, <br />Launching Ramps and Docks in Exce.ss of 100 feet, for District <br />Mooring areas, Deicing, Special Density, Variances and for <br />Permanent Docks as recommended by the Committee. The executive <br />director called attention to the addition of Section 7, regarding <br />application deposit fees, recommended by LeFeveve. Babcock said <br />this allows the LMCD to avoid a code amendment by not requiring a <br />deposit in the Resolution on certain items. <br />Babcock moved, Hurr seconded, adoption of Resolution 76, as <br />submitted with additional Section 7. Motion carried unanimously. <br />E. Three or Four Boat Storage Study <br />Babcock presented the committee’s recommendation that the <br />staff continue to monitor 3 or 4 boat storage at residential <br />docks as part of the annual boat inventory, in lieu of adopting a <br />code amendment requiring registration for docks storing 3 or 4 <br />boats. The Board concurred with the recommendation. <br />F. Code Amendment Regulating lligf Intensity Lights <br />Cochran said there is a feeling by some Board members tha\. <br />this is not the right ordinance because it only affects certain <br />kinds of lights. A request for the cities response to the <br />proposed code, sent in November, leaves the opportunity open to <br />amend the ordinance before adoption. <br />Reese said Mound supports the ordinance. Boswinkel <br />commented that this ordinance is in keeping with the Board’s <br />intent. Babcock concurs with the Committee recommendation that <br />the ordinance needs the suppoi't of the cities and further st’udy. <br />The second reading will be held in January to allow the cities to <br />respond. <br />No action wa.s taken. <br />G. Deicing License Applications <br />Babcock moved, Reese seconded, to approve the following <br />renewal and new deicing applications: <br />V <br />2
