p—■ <br />system or shall be treated and disposed of in an on-site system <br />according to the provisions of this Section. <br />B. Jurisdiction. The provisions of chis Section <br />shall apply to the method of sewage disposal from every building <br />within the City intended for human use or habitation, whether such <br />use is permanent, temporary or seasonal, regardless of the date of <br />original construction or use. <br />1. The owners of all buildings where City <br />sewer is available or becomes available, shall connect the <br />buildings to the City sewer within 16 months of the availability of <br />the sewer according to the provisions of the City Code. <br />2. At the time connection to city sewer is <br />completed all existing septic tanks no longer in use shall be <br />pumped out and filled with native soil. <br />3. The owners of those buildings which have <br />been completely connected to City sewer shall be exempt from the <br />maintenance and inspection provisions of this Section. <br />C. Surface Discharge. Unless specifically <br />permitted by MPCA and the City of Orono, sewage, sewage tank <br />effluent, or seepage from a soil treatment system shall not be <br />discharged to the ground surface, abandoned wells, or bodies of <br />surface water, or into any rock or soil formation the structure of <br />which is not conducive to purification of water by filtration, or <br />into any well or other excavation in the ground. <br />All new or existing systems which discharge to surface waters or <br />the ground surface must obtain either a National Pollutant <br />Discharge Elimination System (NPDES) or State Disposal System <br />Persdt from MPCA and shall comply with all federal, state, and City <br />requirements pertaining thereto. <br />D. Standard System Required. In areas not served <br />by City sewer systems, sufficient open land of suitable soil <br />characteristics shall be provided for each new or existing building <br />to allow for the design, construction and use of a "standard" on <br />site system within the property or on which such building is <br />located. Standard systems are the only new systems permitted by <br />this Section without a variance thereto. <br />1. "Alternative systems" shall not be <br />persdtted except by variance. <br />2. "Prohibited Systems" shall not be <br />installed or used except as permitted elsewhere in this code. <br />E. Variances. Should the City find that any of the <br />provisions of this Section are not applicable to the design, <br />location, or construction of a specific system, or would cause <br />unnecessary or unintended hardship to the owner, the City may <br />permit such variations therefrom as are not contrary to the intent
