ORDIHANCB #_ _, SBCOHD SERIES <br />AN ORDINANCE AMENDING SECTION 5.37 OF THE CITY OF ORONO <br />MUNICIPAL CODE RELATING TO ON-SITE SENAGE TREATMENT <br />SYSTEMS CONTRACTOR* AND ADDING SECTION 5.38 RELATING <br />TO ON-SITE SENAGE TREATMENT SYSTEMS SITE EVALUATORS AND <br />DESIGNERS* AND AMENDING SECTION 12.30 RELATING TO <br />ON-SITE SENAGE TREATMENT SYSTEMS. <br />The City Council of Orono does ordain; <br />SECTION 1. Chapter 5 of the Municipal Code of Orono is hereby <br />amended by amending Section 5,37, Subd. 4 to read as follows: <br />Subd. 4, MPCA Certificate. Applicant shall hold a <br />current. "Individual Sewage Treatment Systems Certificate" issued <br />by the Minnesota Pollution Control Agency. Applicants holding a <br />'provisional* certificate shall be subject to staff review of the <br />applicant to determine their competence. <br />SECTION 2. Chapter 5 of the Municipal Code of Orono is hereby <br />amended by adding Section 5.37, Subd. 5, as follows: <br />Subd. 5. Approval by Council. Applicant shall satisfy <br />the Council that the applicant is qualified by training and <br />experience to engage in the business of constructing or pumping on­ <br />site systems in accordance with the requirements of the On-Site <br />Sewage Treatment provisions of the City Code. <br />SECTION 3. Chapter 5 of the Municipal Code of Orono is hereby <br />asMnded by adding Section 5.38, as follows: <br />SBC. 5.3t ON-SITE SENAGE TREATMENT SYSTEMS SITE EVALUATOR AMD <br />DESIGNER- <br />Subd. 1. License Required. It is unlawful for any <br />person to engage in the business of on-site system site evaluation <br />and system design without a license therefor from the City. This <br />license shall be a separate license from the "On-Site Sewage <br />Treatment Systems Contractor ” license. <br />Subd. 2. License Fee. Licenses provided for in this <br />section shall be issued only upon payment in full of the license <br />fee fixed and determined in accordance with City Code Section 1.05. <br />Subd. 3. MPCA Certificate. Applicant shall hold a <br />current "Individual Sewage Treatment Systems Site Evaluator and <br />Systems Design Certificate" issued by the Minnesota Pollution <br />Control Agency. Applicant holding a 'provisional* certificate <br />shall be subject to staff review of the applicant to determine <br />their coBtpetence.
