A RESOLUTION VACATING AN <br />LTVUSED PORTION OF FOREST BOULEVARD <br />WITHIN THE PLAT OF SAGA HILL REVISED, <br />SECTION 7, TOWNSHIP 117, RANGE 23 <br />IN THE CITY OF ORONO, .MINNE:S0TA <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under llie laws of the State of Minnesota: and <br />WHEREAS, on M.^ 27, 1988, Michael J. Kellen and Linda C. Kellen, 1435 <br />Park Drive, filed a petition with the City of Orono requesting the vacation of a portion of Forest <br />Boulevard originally dedicated in the Plat of Saga Hill Revised legally described as follows: <br />That part of vacated Forest Boulevard as dedicated in the plat of <br />"Saga Hill Revised, Hennepin Co. Minn." which lies between the <br />northwesterly extensions across it of the nonheasterly line of Lot <br />6, Block 15, "Saga Hill Revised, Hennepin County, Minn." and <br />the southwesterly line of Lot 7, said Block 15. <br />WHEREAS, after due published and posted notice, public hearings were held <br />before the City Planning Commission on June 20, 1988 and March 15, 1993, regarding said <br />vacation and all interested persons were given an opportunity to be heard; and <br />WHEREAS, after uue standing and consideration, the Planning Commission <br />recommended approval of the requested vacation and the Council of tlie City of Orono finds that <br />said vacation as proposed, is in keeping with the public intere-^t in consideration of tne following <br />findings: <br />I. The vacation does not affect the access or the use «'f adjoining properties. <br />2. <br />3. <br />The City has not and does not intend to develop, improve, or u.^ the dedicated <br />right-of-v'ay or Forest Boulevard for road purposes. <br />The City has not and does not intend to maintain or install utilities w'ithin the <br />dedicated right-of-way of Forest Boulevard. <br />Pace 1 of 2
