A RESOLUTION VACATLNG AN <br />UNUSED PORTION OF FOREST BOULEVARD <br />WITHIN THE PLAT OF SAGA HILL REVIS'ilD, <br />SECTION 7, TOWNSHIP 117, RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on May 27, 1988, Robert T. Howells, 1423 Park Drive, filed a <br />petition with the City of Orono requesting the vacation of a portion of Forest Boulevard <br />originally dedicated in the Plat of Saga Hill Revised legaliy described as follows: <br />That part of vacated Forest Boulevard as dedicated in the plat of <br />"Saga Hill Revised, Hennepin Co. Minn." which lies between the <br />northwesterly extensions across it of the Northeasterly line of Lot <br />4. Block 15, "Saga Hill Revised. Hennepin Co. Minn." and the <br />southwesterly line of Lot 5, said Block 15. <br />WHEREAS, after due published and posted notice, public hearings were held <br />before the City Planning Commissiem on June 20, 1983 and March 15. 1993, regarding said <br />vacation and all interested persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommended approval of the requested vacation and the Council of the City ot Orono finds that <br />said vacation as proposed, is in keeping with the public interest in consideration of the following <br />findings: <br />1. The vacation diK‘S not affect the acces;> or the use of adjoining properties <br />The Citv has not and does nor intend to develop, irr.pr'^ve, or use the dedicated <br />. ight-of-way or Forest Boulevard for road purposes <br />3.The City has not and does nut intend to maintain or iastall utilities within the <br />dedicated richt-of-wav ot Forest Boulevard. <br />Pane 1 of 2 <br />L.-
