(a) Whenever the provisions of this chapter refer to the Community Management Plan,official controls, <br /> or other provisions of this Code,codes,regulations or laws,it shall be deemed to refer to those official <br /> controls, plans, codes, provisions of this Code,and regulations as amended as of that point in time. In <br /> the event of an amendment during the application for a subdivision, that subdivision must meet the <br /> requirements of the amendment. <br /> (b) For the purpose of providing for the public health, safety and general welfare,the city may from time <br /> to time amend the provisions imposed by this chapter. <br /> Sec. 82-11.-Jurisdiction. <br /> This chapter shall apply to all subdivisions of land located within the corporate limits of the city. <br /> Sec. 82-12.-Compliance. <br /> a) The subdivision of any lot or any parcel of land for the purpose of sale,transfer or lease by use of <br /> metes and bounds description, deed,contract for deed,purchase agreement,registered land survey <br /> or easement shall not be permitted except after full compliance with this chapter. <br /> b) All subdivisions shall be platted in accordance with the terms and conditions of this Chapter. <br /> c) No building permit or certificate of occupancy shall be issued for any parcel or lot of land which <br /> was created by subdivision and not in conformity with the provisions of this chapter, and no <br /> excavation of land or construction of any public or private improvements shall take place or be <br /> commenced except in conformity with this chapter. <br /> d) No subdivision shall be entitled to be recorded in the county recorder's office or have any validity <br /> until the subdivision has been prepared, approved and acknowledged in the manner prescribed by <br /> this chapter. The office of the county recorder shall not file or accept for filing any subdivision of <br /> land unless it is accompanied by a certified copy of the resolution of the city approving the <br /> subdivision. <br /> e) Every person who violates any provision of this chapter when performing an act thereby prohibited <br /> or declared unlawful, or fails to act when such failure is thereby prohibited or declared unlawful, <br /> and upon conviction thereof, shall be punished as for a misdemeanor except as otherwise stated in <br /> specific provisions this chapter. <br /> f) Appropriate actions and proceedings may be taken by law or in equity to prevent any violation of <br /> this chapter to prevent unlawful construction, to recover damages, including attorney's fees, to <br /> restrain, correct or abate a violation, or to prevent illegal occupancy of a building, structure or <br /> premises, and these remedies shall be in addition to the penalties describe above and provided in <br /> State statutes. <br /> Sec. 82-13.- Conditions. <br /> Regulation of the subdivision of land and the attachment of reasonable conditions to the subdivision <br /> of land is an exercise of valid police power delegated by the State to this city. The subdivider has the duty <br /> of compliance with reasonable conditions laid down by the city for design, dedication, improvement and <br /> restrictive use of the land so as to conform to the physical and economical development of the city and the <br /> city's Community Management Plan and to the safety and general welfare of the future lot owners in the <br /> subdivision and of the community at large. <br /> Final Draft page 9 <br />
