in the streets and highways, and the pedestrian traffic movements appropriate to the various uses <br /> of land and buildings, and to provide for the proper location and width of streets and building <br /> lines. <br /> (8) To establish reasonable standards of design and procedures for subdivisions, in order to further <br /> the orderly layout and use of land; and to ensure proper legal descriptions and monumenting of <br /> subdivided land. <br /> (9) To ensure that public and private facilities are available and will have a sufficient capacity to <br /> serve the proposed subdivision. <br /> (10) To prevent the pollution of air, streams, ponds, wetlands, Lake Minnetonka and other bodies <br /> of water; to provide reasonable access to public waters; to assure the adequacy of drainage <br /> facilities;to safeguard the water table; and to encourage the wise use and management of natural <br /> resources throughout the city to prevent their misuse, abuse and overuse and in order to preserve <br /> the integrity, stability and beauty of the community and the value of the land. <br /> Sec. 82-6. -Authority. <br /> Pursuant to the powers and jurisdictions vested through Minn. Stat. chs. 412 and 462 and other <br /> applicable laws, statutes, ordinances and regulations of the State, the city exercises the power of <br /> authority to review,approve and disapprove subdivisions of land within the corporate limits of the <br /> city. <br /> Sec. 82-7.-Minimum standards. <br /> In their interpretation and application,the provisions of this chapter shall be held to be the minimum <br /> requirements for the promotion of the public health,safety and general welfare and prevention of harm to <br /> the public health, safety and general welfare. <br /> Sec. 82-8.- Conflict with public provisions. <br /> This chapter is not intended to interfere with, abrogate,or annul any other provision of this Code, <br /> rule or regulations, statute,or other provision of law. Where any provision of this chapter imposes <br /> restrictions different from those imposed by any other provision of this chapter or any other provision of <br /> this Code,rule or regulation, statute or other provision of law,whichever provisions are more restrictive <br /> or impose higher standards shall control. <br /> Sec. 82-9.- Saving provision. <br /> This chapter shall not be construed as abating any action pending under or by virtue of prior existing <br /> subdivision regulations, or as discontinuing, abating,modifying or altering any penalty accruing or about <br /> to accrue, or as affecting the liability of any person,or as waiving any right of the city under any section <br /> or provision existing at the time of adoption of this chapter, or as vacating or annulling any rights <br /> obtained by any person, or as waiving any right of the city under any section or provision existing at the <br /> time of adoption of this chapter, or as vacating or annulling any rights obtained by any person,by lawful <br /> action of the city except as shall be expressly provided for in this chapter. <br /> Sec. 82-10.-Amendments of other provisions of this Code and regulations. <br /> Final Draft page 8 <br />
