which requires a location on,below or above the ground, land or water, or attached to something having a
<br /> location on the ground, land or water.
<br /> Subdivider means any person who:
<br /> (1) Has an interest in land, who causes it, directly or indirectly to be divided into a subdivision;
<br /> (2) Directly or indirectly sells, leases or develops, or advertises for sale, lease or development, any
<br /> interest, lot,parcel, site, unit or plot in a subdivision;
<br /> (3) Engages directly or through an agent in the business of selling, leasing, developing or offering
<br /> for sale, lease or development a subdivision or any interest, lot, parcel, site, unit or plot in a
<br /> subdivision; or
<br /> (4) Is directly or indirectly controlled by or under direct or indirect common control with any of the
<br /> foregoing.
<br /> Subdivider's agent means any person who represents or acts for or on behalf of a subdivider in
<br /> selling, leasing or developing, or offering to sell, lease or develop, any interest, lot, parcel,unit, site or
<br /> plot in a subdivision.
<br /> Subdivision means the separation of an area,parcel or tract of land under single ownership into two
<br /> or more parcels,tracts, lots or long-term leasehold interests,where the creation of the leasehold interest
<br /> necessitates the creation of streets,roads or alleys,for residential, commercial, industrial or other use or
<br /> any combination of such uses, except those separations:
<br /> (1) In which all the resulting parcels, tracts, lots or interests will be 20 acres or larger in size and
<br /> 500 feet in width for residential uses and five acres or larger in size for commercial and industrial
<br /> uses.
<br /> (2) Creating cemetery lots.
<br /> (3) Resulting from court orders, or the adjustment of a lot line by the relocation of a common
<br /> boundary as long as each of the resulting lots meets the requirements of chapter 78.
<br /> Surface water management plan means a compilation of policy statements,goals, standards,maps
<br /> and action programs for guiding the future hydrological and hydraulic development of the watersheds and
<br /> subwatersheds,water storage areas, drainageways, floodways and filtration systems of the city to control
<br /> surface water runoff,flood hazards,flood damage and general water quality within the city and its
<br /> environs,including lakes, streams, wetlands,marshes,natural watercourses and storm sewer systems or
<br /> facilities.
<br /> Temporary improvement means improvements built and maintained by a subdivider during
<br /> construction of the subdivision.
<br /> Tract and subject tract mean the parcel of land comprising all the contiguous land owned or
<br /> controlled by the subdivider and included in whole or in part in the subdivision.
<br /> Transportation plan means a compilation of policy statements,goals, standards, maps and action
<br /> programs for guiding the future development of the various modes of transportation of the city and its
<br /> environs, such as streets and highways,public transit,railroads, air transportation,trucking and water
<br /> transportation; and includes a major thoroughfare plan.
<br /> Wetlands as defined in circular 39, "Wetlands of the United States", 1971 edition, United States
<br /> Department of the Interior as amended from time to time.
<br /> Water system, individual, means a water system which may include supply,treatment and
<br /> distribution which serves only one lot(e.g.,private well).
