b.The proposed addition and the comprehensive use of the expanded <br />structure will have no negative impact on the surrounding residential zone <br />and developed properties. <br />c.The proposed addition will not create the need to redirect drainage. <br />Drainage will continue to sheet flow over paved areas to southern lot line <br />and eventually to drainageway within municipal owned property. <br />d.The proposed multiple uses ire compatible and related to other school <br />uses associated with the total comprehensive campus use. <br />4.The Council finds that granting a conditional use permit to allow construction of <br />an addition to the day care/school structure will not be detrimental to the health, <br />safety or general welfare of the public, would not adversely affect light, air nor <br />pose a fire hazard or other danger to neighboring properties, nor will its use <br />depreciate surrounding property values and that the proposed level of use of the <br />propeny will be in keeping with the intent and objectives of the Zoning Code and <br />Comprehensive Pian of the City. <br />5.The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a conditional use permit per Municipal Zoning C(^e Sectu^in 10.28, Subdivision 3 (A) to <br />permit construction of a 36 ’ x 50 ’ addition to tlie existing school/day care stmcnire per plans <br />submitted by LOS Architecture dated January 22, 1993. Sheets 1 - 3 (P) and as amended below <br />for the property located at 770 Old Crystal Bay Road North, subject to the following conditions: <br />1.Applicant shall provide an executed Developer ’s Agreement and appropriate <br />security to ensure all required improvements have been installed to the City's <br />satisfaction per plans submitted for this current review. <br />Pace 2 of 5 <br />A
