Current Ordinance No. 81, Second Series
Regulating Tobacco Sales and Purchases.
2. Proposed Ordinance Amending Ordinance No. 81,
Second Series
At its February 22nd meeting the Council directed staff to draft an
amendment to the current tobacco ordinance. The current ordinance
totally prohibits the sale of cigarettes from vending machines.
This prohibition is to make it more difficult for minors to
purchase cigarettes. The amendment is to prohibit cigarette sales
from vending machines except .in establishments with an on-sale
liquor license. It was the consensus of the Council that because
these establishments do not allow minors, except when accompanied
by a parent or guardian, the allowing of vending machines would not
increase the availability of cigarettes to minors.
The Council also directed that the amendment prohibit vending
machines from being located in the entrance area of the licensed
establishment, and chat the machines be located at least 20 feet
from the entrance and within easy view of the establishmeAit' s
employees. The attached ordinance amends the current tobacco
ordinance as directed by the Council.
