A RESOLUTION VACATING <br />AN UNUSED PORTION OF FOREST BOULEVARD WITHIN THE PLAT <br />OF SAGA HILL REVISED SECTION 7, TOWNSHIP 117 RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />FILE NO. 1798 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing under <br />the laws of the State of Minnesota; and <br />WHEREAS, on January 20, 1993. Fred S. Ryan and Barbara Ryan filed a petition with <br />the City of Orono requesting ihe vacation of a portion of Forest Boulevard originally dedicated <br />in tl'C plat of Saga Hill Revised legally described as follows: <br />That part of Forest Boulevard as dedicated in the Plat of "Saga Hill Revised, Hennepin <br />County, Minnesota" which lies between the northwesterly extensions across it of the <br />southwesterly line of Lot 7, Block 6, "Saga Hill Revised Hennepin County, Minnesota" <br />and a straight line running from the mid-point of the northwesterly line of Lot 5, said <br />Block 6 to the mid-point of a southeasterly line of said Lot 5; and <br />WHEREAS, after due published and posted notice, a public hearing was held before <br />the City Planning Commission on February 16, 1993, regarding said vacation and all interested <br />persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommended approval of the proposed vacation and the Council of the City of Orono finds that <br />said vacation as proposed is in keeping with the public interest and in consideration of the <br />following findings: <br />1 . The vacation does not affect the access or the use of adjoining properties <br />2.The City has not and does not intend to develop, improve, or use the dedicated <br />right-of-way of Forest Boulevard for road puqjoses. <br />3.Tlie City has not and does not intend to maintain or install utilities within the <br />dedicated right-of-way of Forest Boulevard. <br />Pace I of 2 <br />J
