Height is now to be governed by existing elevations and not final <br />proposed elevations. In this case, review Exliibit Q, the vertical distance was determined from <br />the highest adjoining ground level (939.1’) as it proved to be lower than the lowest ground level <br />plus 10’. Proposed home is designed with a mansard roof based on the code section the <br />measurement is taken to the deck line of the mansard roof, refer to Exhibit M. Applicant notes <br />that if structure was designed with a gable roof there would be no height problem, refer to <br />Exhibit N. The applicant advises that based on the new interpretation of allowed height that 2 <br />1/2 story' colonial homes with mansard roofs and full basements would technically not be <br />allowed in the City. The impact is intensified for this property win full basement as the <br />structure must be raised to meet required 1’ separation from adjacent uood plain or OHW of <br />wetlands at 932 elevation. O’Laughlin. <br />Review of Hardships <br />1.Review Exhibits K 1-2, proposed house on Lot 5 is -setback approximately 267 ’ <br />from Old Beach Road. The total height of the proposed structure would be <br />perceived as lower than the existing adjacent structures. <br />The locations of all the structures were established by recorded soil borings <br />determined to be the most suitable for building. If there is to be a basement, <br />basement levels would be above finished grade based on the flood plain of the <br />area. <br />3.Structures on Lots 4 and 6 based on sloping grades w ith walkout and the design <br />of tlie roof are allowed a total building height of 42 ’.
