The location of all the residential stnictures for the Marsh at I^fayette <br />were established by recorded soil borings determined to be the most <br />suitable for building. If there is to be a basement for a residence <br />structiirt*, the basement levels would be above finished grade based on the <br />elevation of the flood plain and the need to build at least 1 ’ above the <br />flood plain elevation. <br />Structures on Lots 4 and 6 based on sloping grades with walkouts and the <br />design of the roof are allowed a total building height of 42’. <br />The total building height for proposed residence on Lot 5 is 34’10" as <br />measured from the highest existing elevation 939.1. The grade is <br />consistent around all elevations of the proposed building. The house on <br />Lot 6 measures 30’ from the street side and 39’ to the rear. The house <br />on Lot 4 measures 30’ from the street yard and 41’ from the rear. <br />Tlie proposed house on Lot 5 will acmally be 6 ’ lower than the adjacent <br />residences. <br />A classic 2 1/2 story colonial with mansard roof could not be built based <br />on the limitations of the building height section and the flood plain <br />elevation and could only be installed with a walkout design which may not <br />be suited for a traditional colonial style. <br />The City Council finds that the conditions existing on this propeny are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting tlie variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring properly; would not merely <br />sc’ve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial propert)’ <br />right of ;'»ic applicant, and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />Tlie City Council has considered this application including the findings and <br />recommend.uions of the Planning Commission, reports by City s»aff, comments <br />by the applicant and the effect of the proposed variance on the health, safet>’ and <br />Page 2 of 5
