Planning Commission conditioned approval on catering be <br />eliminated if problems result. It would certainly be to the owner ’s benefit to know if septic <br />capacity is available before he expends appreciable amounts of money in developing a sprinkler <br />system for the building. Both applicant and owner have been made aware of the septic issues <br />ever since the early preliminary discussions of this application. It has been impossible to <br />provide the septic testing at this time of year. <br />Please review the enclosed staff packet prepared for the Planning Commission and <br />minutes of the Planning Commission for background on the application. <br />Options of Action <br />To approve the conditional use permit for LuAnn Walters based on the Planning <br />Commission recommendation for the property located at 3800 Wayzata Blvd. to allow <br />a daycare use to be installed in the existing structure. The daycare use to be limited to <br />a student-teacher use level of 60. Use shall consist of limited catering service to clients <br />of daycare. Findings and conditions of the Planning Commission recommendation have <br />been set forth in the enclosed resolution; or <br />To limit Council ’s approval to the first stage of the daycare operation that would make <br />use of the existing facility and septic system w ithout the need of a sprinkler system at the <br />29 student-teacher level use. Limited catering would be allowed. The City will require <br />a water meter to be installed so that water use can be determined. Applicant can proceed <br />with the second stage of the conditional use permit as soon as septic testing confirms a <br />reasonable use level for property. First stage improvements will require the relocation <br />of the curb cut to the east and striping of approved parking stalls and per County ’s <br />permit the possible removal of paved areas within right-of-way. Applicant/owner will <br />be required to execute a developer ’s agreement and post appropriate security until all <br />required improvements are completed within a reasonable period of time. In the first <br />stage, applicant may not wish to proceed with an open fenced play area. The installation <br />of play area and additional landscaping would be postponed until the maxunum use level <br />is resolved with the second stage review . <br />The enclosed resolution can be amended to reflect approval of first stage of conditional <br />use permit. <br />cb
