The lot at that time met the 25,000 s.f. area and 120' <br />lot width standards. The lot became substandard in 1959. The area <br />standard was increased to 1 acre. Similar sized lots in the area <br />were allowed to be built on without variances unt'l 1975 when the <br />area was rezoned to 2 acres. Two undeveloped lots were developed <br />since 1975. Both were granted variances to rural standards. The <br />property at 190 Cygnet Place at .65 acres was approved in 1977 and <br />the property at 20 Cygnet Place at 1.37 acres was approved in 1988. <br />Refer to Exhibit G. Of the total developed 24 lots, the average <br />lot size is 1.02 acres and range in size from 0.60 acres to 2.15 <br />acres. <br />Description of Request <br />The subject property was included within the recent Stubbs Bay <br />Sewer project and has been assessed a single sewer unit. The <br />applicant now seeks an area variance, a setback variance from the <br />protected tributary and hardcover variance within the 0 75' setback <br />area to construct the proposed residence. <br />Prior to the Shoreland Regulations, the setback from the <br />tributary would have been 26'. Review Exhibit F, the building <br />envelope defined at a 26' setback from the tributary and a 25' road <br />dedication defines an adequate building ei.velope for residential <br />development. With the new Shoreland Regulations, the building <br />envelope shown in Exhibit J is severely impacted. The Public Works <br />Director has asked for a 30' dedication for Leaf Street. If the 30' <br />easement is approved, applicant would also be seeking a street <br />setback variance.
