6 . <br />violate the land use policies against increased <br />density because the only new building site would <br />exceed the required lot area size for land zoned <br />RR-IB. In essence, in that memo the applicant's <br />property was used to highlight those circumstances <br />where a variance and subdivision of property should <br />be allowed. <br />N) The City Council finds that the conditions existing <br />on this property are peculiar to it and do not <br />apply generally to other property in this zoning <br />district; that granting the variance would not <br />adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring <br />property; would not merely serve as a convenience <br />to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary <br />to preserve a substantial properr.y right of the <br />applicant, which right was established upon City <br />adoption of Resolution #1178, and on which <br />applicant has relied for more than ten years; and <br />would be in keeping with the spirit and intent of <br />the Zoning Code and Comprehensive Plan of the City. <br />The Council finds that not only do the above findings <br />support the granting of a variance to Municipal Code <br />Section 10.28, Subdivision 5 (B) , but said findings <br />further indicate that the conditions surrounding this <br />request are of such a unique and singular nature as to <br />support the granting of a variance to the Subdivision <br />Code Section 11.10, Subdivision 14 (A) which states in <br />part that "Every plat shall conform to existing zoning <br />regulations and subdivision regulations applicable at the <br />time of final plat approval. Variances shall not be <br />approv'ed to increase the overall subdivision density <br />above the minimum lot area requirements of the applicable <br />zoning district in this chapter". <br />Page 6 of 9
