Building & Zoning Administrator <br />December 3. 1993 <br />#1850 James Spinner, 940 North Arm Drive - Variances <br />\ <br />\«.N <br />V ^ <br />V <br />u <br />Status of Application <br />Per Council ’s directive at the October 25lh meeting, the amended application was <br />presented to the Planning Commission for further consideration and recommendation. The <br />enclosed staff memo reviews the amended hardcover facts per the revised improvement plan. <br />The four member Planning Commission reviewed the amended proposal resulting in the <br />removal of an additional 250 s.f. of paved area to the lakeside of the proposed garage stall <br />Members questioned whether additional non-structural improvements could be removed to the <br />north side of residence consisting of a concrete paved area (0-75 ’ - 55 s.f., 75-250 ’ - 308 s.f.). <br />Mr. Herstein, applicant ’s contractor, noted this would require major land alterations into the <br />steeper slopes and felt that the e.xisting improvement solved the drainage problem on the north <br />side. The Planning Commission was unable to affect any other additional hardcover removals. <br />Planning Conuiiission Recommendation <br />The Planning Commission voted to deny the variance application of James Spinner as <br />shown in the recent amended proposal based on the following findings: <br />1. The improvement involved new pennanent structural hardcover within the 0-75 ’ <br />setback area w'here excesses exist and where none is allowed. <br />2. The variance requested and the existing hardcover excesses are extreme. <br />Applicants have presented inadequate concessions to offset these e.xcesses. <br />Council Action <br />To provide staff with cmiceptual direction so that an appropriate resolution can be <br />presented to the Council at their January 10. 1994 meeting.
